Town + Country Stays owns and operates a range of high quality hosted storied stays in the Goulburn Valley. We are committed to providing a stand out stay for all our guests. Below outlines the terms and conditions of stay at The Storekeeper’s House - Tatura and Miss Boulevard - Shepparton.

Town + Country Stays properties have the following check in and check out times*. Self check in applies via lock box.

*Earlier check in or later check out maybe arranged where possible subject to availability. Additional fees and charges may apply. Please contact us at least 48 hours prior to arrival to discuss.

TOWN + COUNTRY TERMS, CONDITIONS & POLICIES

1.    Interpretation
1.1. The following Terms and Conditions apply to all accommodation bookings with Town + Country Stays (bookings) and any other related services provided in connection with bookings. The Terms and Conditions apply to the person making the booking (client) and any accompanying guests.
1.2.  By making a booking with us, the client automatically acknowledges that these Terms and Conditions have been read and agrees to be bound by them.
1.3.  We reserve the right to vary these Terms and Conditions at any time by posting an updated version on our website.
1.4. The Terms and Conditions should be read in conjunction with the HRIA Code of Conduct https://hireandrental.com.au/wp-content/uploads/2019/09/HRIA-Code-of-Conduct-2019.pdf 

2. Liability
2.1. The client and any accompanying guest will not hold Town + Country Stays or the property owner responsible for any damage to the accommodation, equipment provided and/or surrounding property of the owner (property) caused in connection with the use of the property for the purpose of the booking.
2.2. The client will indemnify Town + Country Stays and/or the owner for any damage caused to the accommodation and/or property in connection with the booking. This includes damages, insurance, loss due to fire, loss due to misadventure, theft, injury or death.
2.3. The client and any accompanying guest will not hold Town + Country Stays or the landowner liable for any loss, damage, injury, death, legal actions, insurance claims or expenses which the client might assert from an event arising from, or in connection with, the use of the property for the purpose of the booking.

3. Booking terms
3.1. The client must record the name and requested details of each guest to be included in the booking.
3.2. Any persons not listed on the relevant booking are not permitted to enter the property or the accommodation at any time.
3.3. The client must notify Town + Country Stays immediately of any changes to the persons attending the booking.
3.4. Failure to adhere to this section may result in a penalty charge of $100.00 per night per person not recorded as a guest under the booking.
3.5. Town + Country Stays reserves the right to hold a $500 security bond or the credit card details used for the booking securely on the system as a security bond. This nominated card will be automatically debited in the event of: damage to the property, equipment, breakages, extra cleaning or as deemed in the full listing of these Terms and Conditions. The client gives authority for the deduction of any additional fees, charges or reimbursements as set out in these Terms and Conditions.

4. Booking cancellations and variations
Cancellations
4.1. A client must cancel a booking by emailing hello@thestorekeepershouse.com.au and include the booking reference in this communication.
4.2. In the event that a client cancels a booking at least 14 days before the date of check-in, Town + Country Stayswill refund the client the total amount of the booking cost minus a service fee of 15% of the total booking cost.
4.3. In the event that a client cancels a booking at least 14 days before the date of check-in, Town + Country Stays will refund the client the total amount of the booking cost minus a service fee of 15% of the total booking cost. With 8-13 days notice in writing prior to the date of check-in Town + Country Stays will refund the client the total amount of the booking cost minus a cancellation fee of 50% of the total booking cost.
4.4. Town + Country Stays will not provide any refund for booking cancellations provided less than 7 days from the date of check-in.
4.5. In the event that a client fails to attend all or part of their booking, Town + Country Stays will not provide a refund.
4.6. Please note that terms 4.1. to 4.6. may be varied at the discretion of Town + Country Stays

Variations
4.7. A client must vary a booking by emailing hello@thestorekeepershouse.com.au with the booking reference number and the varied booking details/request.
4.8. It is at the discretion of Town + Country Stays to accept or decline a change to a booking.
4.9. If Town + Country Stays accepts a change to the original booking, the updated booking will be considered to be a new booking.
4.10. If Town + Country Stays is unable to accommodate the requested changes to a booking, and the client cannot attend the original booking, it will be treated as a cancellation and terms 4.1. to 4.6. will apply.

5. Weather and natural disasters
5.1. Please note that due to the extremes of weather conditions experienced in the Goulburn Valley, we are unable to guarantee your comfort in extreme weather conditions. Town + Country Stays properties are equipped with the following:

The Storekeeper’s House - Tatura: an air-conditioner/heater in the living area, ceiling fans and heaters in each room, a wood heater fireplace in the living room and evaporative cooling throughout.

Miss Boulevard - Shepparton: ducted electric air-conditioning/heating throughout, ceiling fans in each room, and evaporative cooling throughout.

In summer (specifically January and February) it can get hot and humid and similarly to any Victorian regional area there is bush fire risk and for this reason we recommend you consider your dates carefully.

In winter, temperatures drop and can get below zero overnight. Daytime temperatures can average 13 degrees celcius.

With climate change, throughout the year like much of Australia the region can experience unseasonal high rainfalls and extreme weather. We encourage you to check the Bureau of Meterology (BOM) We also strongly recommend you take out travel insurance to cover your reservation in the event of extreme weather and/or natural disasters, and carefully check the T&Cs.


5.2. Terms 4.1. to 4.4. do not apply to circumstances of inclement weather conditions or natural disasters that may put any persons in real danger of accessing the location of the accommodation. This only includes weather conditions or natural disasters that are present in the area of the accommodation which may impede safe access to the accommodation.
5.3. In situations where term 5.2. applies the client can choose from one of the following options:
5.3.1. a new booking worth the same value as the original booking; or
5.3.2. a voucher for accommodation with The Storekeeper’s House of the same value as the original booking 

6. Contact for assistance
6.1. The client can request assistance during their stay at any time by contacting Town + Country Stays via text message to 0415 581135 .
6.2. In the event of an emergency, the relevant emergency services should be called immediately by calling 000.  Details of local emergency services (ie hospital, police, nurse on call etc) are included in the house manual.

7. Pets

Small to medium house trained dogs maybe accommodated at the property on application with the client advising Town + Country Stays of the size, breed and age of the pet.   Town + Country Stays reserves the right to refuse any application at anytime.

7.1. Additional fees are payable.  The client is responsible for cleaning up and disposing of any/all pet refuse.  This includes covering the cost of carpet cleaning or professional laundering if pets soil the carpet, bedding or furniture in any way.

7.2. Pets are not allowed on furniture or beds at any time and are encouraged to remain out of the carpeted spaces.  Any evidence of pets on furniture or bedding will incur extra cleaning fees.

7.3. It is recommended that all pets are to be treated with a topical flea and tick repellent three (3) days prior to arrival.  Fleas and ticks maybe present in this area and can cause harmful/fatal illness to humans and pets.

7.4. Pet must not cause damage to premise or furnishings. If damages are caused, terms 9.1 – 9.4 will apply.

7.5. Guest should prevent pets from producing excessive noise at a level that disturbs neighbours.

7.6. Pets will not be left unattended for an undue length of time.  Pet will not be left unattended indoors at any time.

7.7. Town + Country Stays assumes no responsibility for illness or injury that may incur to pets or humans while on the premises.  The client shall be solely responsible for the pet while on the property.

8. Smoking
8.1. Smoking is prohibited in or near the accommodation. Failure to comply may result in a penalty and cleaning charge of $1000.00, which will be charged to the nominated credit card.

9. Furniture, Breakages and Damages
9.1. All furniture must remain at all times in the position it is upon your arrival at the property, no furniture is to be moved from this position or around the property at any time.

9.2. In the event that any part of Town + Country Stays, including interior and exterior areas, as well as any furniture, flooring, furnishings, appliances or household items are damaged, broken or removed during the stay, an amount equal to the repair or replacement cost for the goods will be charged to the nominated credit card or invoiced for repair at the cost of the guest. Town + Country Stays accommodation is designed to a high standard, and are finished and furnished with unique and often one of a kind materials and products. Every guest registered is personally responsible for all charges and remain liable for all damages of the accommodations or the property therein or the landowner’s property, or any discrepancies during their stay, due to actions of themselves or their guests. In the event of foregoing, the registered guests give Town + Country Stays the authority to charge the registered guest for any losses incurred by Town + Country Stays.

9.3. The guest must not remove any item from Town + Country Stays that does not form part of his/her personal belongings. In the event that any items are missing from the property after the guest’s departure, the cost of replacement will be charged to the nominated guest.
9.4. This includes failure to exit the accommodation properly and leave the property in the condition it was found in (eg failure to turn off heating/cooling, close windows, secure the key in the key lock box).
9.5. The guest must notify Town + Country Stays immediately of any damage to the property including its fixtures, furniture and furnishings.

9.6. Windows and doors must be locked and secured upon checkout and when the guest is not present at the property.

9.7. Nothing is to be nailed, screwed, fixed, glued or taped to any part of the property or contents, including but not limited to walls, doors or surfaces.


10. Lockouts and loss of key
10.1. In the event of loss or damage of the key to Town + Country Stays a $250 key replacement fee will be payable by the client to cover the costs and time associated with call outs .  In addition if a locksmith is required to attend due to a broken or lost key, the associated costs will be paid by the client.

 11. Fires
11.1. The only fire permitted at Town + Country Stays is the use of wood heater fire in The Storekeeper’s House and fire pit in the rear yards at both The Storekeeper’s House and Miss Boulevard. All other fireplaces are decorative in nature only and under no circumstances should a guest attempt to light. This includes the fireplace in the lounge at Miss Boulevard and the fireplace in the bedroom at The Storekeeper’s House.

12. Commercial use of The Storekeeper’s House and Miss Boulevard – Photoshoots
12.1. Unless we agree otherwise in writing, commercial use of The Storekeeper’s House and Miss Boulevard is strictly prohibited. While we are more than happy for our guests to take photographs and videos for their own personal purposes, any commercial photoshoots at The Storekeeper’s House and Miss Boulevard are prohibited unless we have provided prior written approval.

No images including the property are to be used for marketing purposes unless pre-approved in writing by us.

All filming and photography requests must be sent prior to the date of arrival and subject to the discretion of Town + Country Stays and are subject to location fees to be determined based on the type of shoot and intended commercial use. 13. No Tenancy
13.1. The guests agree that regardless of the length of stay at The Storekeeper’s House or Miss Boulevard the guests are not tenants of Town + Country Stays and will have no rights in relation to tenancy.

14. Breach of the Terms and Conditions
14.1. In the event that the client or guest fails to comply with the aforementioned Terms and Conditions, Town + Country Stays reserves the right to ask the client and guest to leave the accommodation and property immediately, and the client in question cannot request any form of compensation. Any and all total loss or damage that Town + Country Stays suffers as a result of that breach will be charged to the nominated guest’s credit card or other form of payment assured.

15. Your stay
15.1. Your confirmation email will provide all the necessary details regarding your stay with Town + Country Stays. Please familiarise yourself with Town + Country Stays policies and T&Cs and get in touch with us if you have any questions before check-in.

15.2. Maximum occupancy of both The Storekeeper’s House and Miss Boulevard accommodation is up to six (6) guests and one infant. Children two years old and older are considered a guest. Only those persons indicated in the booking made by the client may enter the property, unless an alternative agreement has been reached with Town + Country Stays.

15.3. Children must be supervised at all times, particularly around kitchen utensils and fireplaces and curios. The owners are not responsible for any children staying at or visiting the property. A complimentary porta-cot can be supplied for children under the age of 2 years. Guests are required to supply linen for this cot and must be set up by guests. No refund will be given if the accommodation is deemed unsuitable after check in.  All minors under the age of 18 years must be accompanied by a parent or legal guardian at all times.

15.4. Fireplaces and firepits are to be operated by adults over the age of 18 only and are operated at your own risk. You will be held liable for any damage you cause including smoke or ember damage from incorrect use. If using the firepit, you will ensure the firepit is not moved from it’s current location and is put out entirely whenever you leave the premises even for short periods. Supervision of children around all fireplaces is required and is the responsibility of parents/guardians.

NB: ALL fireplaces and their external casings can get very hot and may cause serious burns if touched. It is strongly recommended that the fireplaces not be operated when children are staying onsite.

15.5. Check in from 3:00pm. You will be advised prior to your arrival of the check-in procedure and or key code to enable access. Please park at in the driveway or in the street parking directly out front of the house.  You can then access the House from the front door. You must not drive or park elsewhere on the property, for your safety and with respect for the land owner, and will be held responsible for all injuries, losses and damages caused if this is not adhered to.

15.6. Check out at 10:00am. Rubbish and recycling must be removed and placed in the outdoor bins provided, and dishes must be clean and returned to their cupboards.  Failure to do so will incur further cleaning fees of $75 + GST per hour or professional removal of excess rubbish at the invoiced amount.

15.7. Our housekeepers will arrive shortly after this time so please make sure you have taken all your personal belongings, close all windows and leave the key back in the key safe unless otherwise advised. Leaving after 10:00am without prior authorisation will result in an additional charge of $75 per hour past your agreed check out time.

15.8. The client agrees to leave the premises in a clean and tidy state upon departure as per check out instructions. In the event of the failure to do so, additional cleaning fees may apply. These additional fees will be charged to the nominated credit card.

15.9. No illegal substances or underage drinking are permitted at the property. Town + Country Stays will not be held responsible for underage drinking and violations of this policy will result in immediate expulsion from the premises without refund, and the involvement of law enforcement.

15.10. The Storekeeper’s House is located on the main street of Tatura, a small yet vibrant town that is home to agriculture and manufacturing.  This means that light and heavy vehicles and pedestrians may pass within the vicinity of the The Storekeeper’s House at any time, day or night and may result in associated noise. The client accepts this as part of their stay.

15.11 Miss Boulevard is located on the Boulevard Shepparton, a pictuesque yet popular access road to the Shepparton Golf Course and residential housing estates.  This means that light and heavy vehicles and pedestrians may pass within the vicinity of Miss Boulevard at any time, day or night and may result in associated noise. The client accepts this as part of their stay.

16. Amendments to the Terms and Conditions
16.1.  Town + Country Stays may make amendments to the Terms and Conditions at any time without prior notice. If any amendments are made, the date of the Terms and Conditions will be updated to reflect the date of changes made. The updated Terms and Conditions will apply to all persons engaging in services provided by Town + Country Stays.

17. COVID 19

17.1. Guests are responsible for ensuring they are adhering to any travel restrictions or legislation in place relating to COVID19.

17.2. Should your stay be affected by government imposed travel restrictions as a result of COVID19, we are offering flexibility in our terms and conditions to allow a credit to postpone your stay. This credit will be valid for use for 6 months from the date of you original stay..

17.3. All guests are advised to carefully consider the government advice and legislation current at the time of their stay with regards to travel restrictions and the number of people permitted to gather together both in indoor and outdoor spaces.

18. Bookings

18.1.  All bookings and booking requests must be made through this Site, or other websites as we designate at our sole discretion.  Once requested, your booking is subject to approval by us in our sole discretion.

18.2. Where we request information regarding guests and payments, you warrant that the information provided in the booking is true, accurate and correct and that false information may result in your booking being cancelled without a refund.  This information will be treated in accordance with our Privacy Policy available on our website www.thestorekeepershouse.com.au

18.3. In order to secure your direct booking you must pay a 50% non-refundable deposit.  The balance of your booking fees are due 30 days prior to your booking commencement.  Where you have provided credit card information we reserve the right to charge that card on that date for the full balance of the booking fees, and any associated security deposits.

18.4. Early arrivals and late check outs are at the discretion of Town + Country Stays and must be requested at the time of booking and can only be confirmed 1 day prior to arrival or departure. Whilst every effort will be made to accommodate early arrivals and late departures, the only way to absolutely ensure an early check-in or late check-out is to book an extra night.

18.5. We do not accept bookings for ‘Bucks’ or ‘Hens’ gatherings or bookings from anyone under the age of twenty-five (25).

19. SUBMITTING CONTENT TO SITE AND SOCIAL MEDIA

19.1. We always appreciate interaction on our social media channels and feedback about our Site, products and services, as it helps us to improve our Site and our products and services. Through the use of this Site and others (ie Airbnb, riparide, google, bookings.com), you may be invited to submit a review, you can also comment on other parts of our Site or interact with us via our social media channels. We love to hear from you!

19.2. Where you do decide to submit such feedback or comments,  you represent and warrant that:

(a) you are the sole author and owner of the intellectual property and any other rights in that content  (or have the right to use that content with appropriate consents and permissions)

(b) give us permission to post or otherwise use that feedback on our social media or other channels and

(c) you waive any and all existing and future moral rights (as defined in the Copyright Act 1968(Cth) in the content you provide us; (d) the content does not violate these Terms; and (e)  you are at least 18 years old.

19.3. We reserve the right to remove a review or comment  if such review or comment  contains:
(a) libellous or otherwise unlawful, abusive or obscene material;
(b) attacks our employees or another contributor;
(c) contains material that discloses your personal information; or
(d) is unrelated to the post or content to which you have reviewed or commented on.

 19.4. Our Site and social media channels may feature user reviews of the products and/or services as well as blogs by guest bloggers, these reviews and content of the guest blogs in no way represent the views or opinions the owners, or others, but are the sole product of its creator.  We disclaim all liability with respect to any content submitted by the user or guest blogger

20. COMPETITIONS

20.1. We may from time to time run competitions through this Site and / or through our social media channels. 

20.2. Your participation in those competitions is subject to these Terms and any terms and conditions that are specific to each competition.  The laws of Victoria will govern all competitions run by us.

21. PROHIBITED USE

21.1. In addition to any other prohibitions, you must, no circumstances use the Site or its content

a.       for any unlawful purpose;

b.       to solicit others to perform or participate in any unlawful acts;

c.       to violate any international, federal, or state regulations, rules, laws, or local ordinances; and

d.       attempt to change, remove, deface, hack or otherwise interfere with this Site or any material or content displaced on the Site.

 22. ASSIGNMENT    

22.1. We are permitted to assign, transfer and subcontract our rights and/or obligations under these Terms without any notification or consent required.  However, you are not permitted to assign, transfer or subcontract your rights and/or obligations under these Terms.

 23. ENTIRE AGREEMENT

23.1. These Terms (together with our Privacy Policy and disclaimers) contained on this Site, constitute the entire understanding and agreement between us and you, in relation to your use of this Site and supersede all previous communications, negotiations, and agreements, whether oral, written, or electronic, respect to this Site and your use of this Site.

 24. GOVERNING LAW AND JURISDICTION

24.1. All Terms shall be construed in accordance with and governed in all respects by the laws of the State of Victoria, Australia.

24.2.  In relation to any dispute, we ask that you contact us in the first instance so that both parties can, acting in good faith, resolve the dispute to our mutual satisfaction as quickly, cost effectively and efficiently as possible. 

24.3. Where a dispute cannot be resolved, you agree to submit to the non-exclusive jurisdiction of the courts of the State of Victoria, Australia. 

Definitions
Client includes any person who makes a booking of accommodation with The Storekeeper’s House,
Guest includes any person who is attending the accommodation in the company of the client and/or person listed in a booking.
Landowner includes the registered landowner(s) of the property that the accommodation is positioned on.
Property includes the entire property of the landowner operated by Town + Country Stays that the accommodation is hosted on.
Person listed in a booking includes persons, other than the client, who are listed on the booking.
Real danger includes persons attending the booking
